Enduring Power of Attorney

An enduring power of attorney is an arrangement that you can make to give authority to a person you know and trust to act on your behalf in circumstances where you lose the capacity to make certain decisions in the future. These decisions can be about your personal welfare and property and money matters.

It is important that you choose one or more attorneys that you trust and know so that the attorney(a) will make the decisions on your behalf when you lose mental capacity.

Your enduring power of attorney is registered with the Decision Support Service and it is only activated if you lose mental capacity to make decision for yourself which is certified by a medical practitioner.

The actual process of making an enduring power of attorney takes a number of steps which includes getting forms completed by different people, including you, your attorney, your doctor or other healthcare professional and a legal practitioner.

You may need a person you trust to help you complete these steps. You can also discuss making an enduring power of attorney with us and we can assist you in your registration of an enduring power of attorney online through the Decision Support Service portal. To do this, you will need an account on MyDSS or alternatively, by using your MyGovID account.

If you decide you wish to create an enduring power of attorney, we are happy to assist you and we'll complete the relevant stages with you and on your behalf (you will have to attend your medical practitioner separately). If you make an appointment for the purposes of creating an enduring power of attorney, we will advise you of the information we require to assist you fully.
